Terms of Service

These terms are the agreement between you and Yellcano. They cover both sides of the product: the creators who run a page, and the viewers who send something to one. Read section 7 if you plan to make a voice, and section 8 if you plan to spend anything.

1. Agreement

By using Yellcano — opening a creator page, sending an interaction, connecting a platform, or running the overlay on a stream — you agree to these terms. If you do not agree, do not use the service.

Our Privacy Policy forms part of this agreement and explains what we do with data.

2. Who may use Yellcano

  • You must be at least 13 years old, and old enough under the rules of any platform you connect.
  • If you are under the age of majority where you live, you may use Yellcano only with the involvement of a parent or guardian, and you may not spend money on it without their permission.
  • You must not use Yellcano if we have previously terminated your access, or if applicable law prohibits us from providing it to you.

3. The service

Yellcano is a viewer-engagement platform for live streams. It provides:

  • A public interaction page for each creator, where viewers can send a message to be read aloud on stream by a text-to-speech voice, trigger a sound the creator has published, or queue a short clip.
  • An overlay that the creator loads into their broadcasting software as a browser source, which is what actually airs the interaction.
  • A creator console for publishing voices, setting prices, creating chat commands, and moderating.
  • Chat connections to Kick, Twitch and YouTube, so that messages in the creator's own chat can trigger the same interactions. Connecting a YouTube channel grants read-only access to that channel's live chat and nothing else; it is described in detail in section 4 of our Privacy Policy. Your use of a connected YouTube channel is also subject to the YouTube Terms of Service.
  • A points system, in which viewers earn points by taking part in a creator's chat and may spend them on interactions where the creator allows it.

Features are configurable per creator and may be switched off entirely. A feature being described here does not mean it is enabled on the page you are looking at.

4. Accounts

  • Viewers may interact as a guest with no account. Signing in with Kick, Twitch or Google adds points, receipts and settings that follow you across devices.
  • You are responsible for what happens under your account and for keeping access to it secure. Tell us promptly at [email protected] if you believe it has been compromised.
  • Do not share an account, sell one, or create one on someone else's behalf without their authority.
  • You may close your account at any time. Closing it does not refund points or reverse interactions that have already aired.

5. Creator responsibilities

If you run a Yellcano page, you decide what your audience can do, and you are responsible for that decision.

  • You are responsible for what airs on your stream, including interactions your viewers send. Yellcano gives you a content floor, blocklists, blocks, mutes, per-kind switches and access tiers; using them is your job.
  • You must comply with the rules of every platform you broadcast on. Nothing here overrides them, and a platform's enforcement action against you is between you and that platform.
  • You may only connect a channel you own or are authorised to act for.
  • You must not use Yellcano to run a lottery, a game of chance, or anything that would make an interaction a regulated financial or gambling product.
  • Prices you set are shown to your viewers before they commit. Do not misrepresent what an interaction does or what it costs.

6. Acceptable use

This applies to everyone. Do not use Yellcano to send, publish, or cause to air:

  • Content that is illegal, or that promotes or facilitates illegal activity.
  • Harassment, threats, hate speech, or content that targets a person or group for abuse.
  • Sexual content involving minors, or any sexualisation of a minor. This is reported, not merely removed.
  • Content that impersonates a real person in a way likely to deceive, or that is presented as a statement by someone who did not make it.
  • Someone else's private information, credentials, or personal contact details.
  • Malware, phishing, or links intended to compromise a viewer.
  • Content that infringes copyright, trade marks, or other rights you do not hold.

And do not:

  • Automate, script or otherwise mass-produce interactions or chat activity to farm points or flood a queue.
  • Circumvent a block, a mute, a rate limit, a quota, a price, or an access tier — including by using another account or another door into the same page.
  • Probe, scrape, reverse-engineer, or interfere with the service or the infrastructure it runs on.
  • Resell, sublicense, or provide the service to third parties as your own.

7. Voices and voice cloning

Yellcano offers a catalog of stock voices and, separately, lets a creator build a custom voice from a reference recording. Custom voices carry rules that are not negotiable:

  • Record your own voice, or a voice you hold documented rights to. Uploading a recording of someone who has not agreed to it is a breach of these terms.
  • No celebrity voices and no character voices. Cloning a public figure, a performer, or a copyrighted character is not permitted, and we will remove such a voice on discovery.
  • No deception. A voice must not be used to make it appear that a real person said something they did not say.
  • A consent recording is required alongside a reference recording, and it is kept as evidence for exactly that purpose.
  • Stock voices are licensed to us and are made available for use inside Yellcano only. You may not extract, redistribute, or use generated audio to train another voice model.

We may remove any voice, at any time, if we believe it breaches this section or exposes anyone to a rights or likeness claim.

8. Points, prices and payments

Prices

What an interaction costs is set by the creator, not by us, and it is displayed on the page before you commit to anything. We do not publish a price list here because there is not one to publish — the price you see in the product is the price.

Payments

  • Payments are processed by a third-party payment provider. Yellcano never receives or stores your card number.
  • You authorise the charge when you submit a paid interaction. You are charged when that interaction is delivered to the stream; if it never airs, the authorisation is released and you are not charged.
  • Prices are shown inclusive or exclusive of tax as indicated at the time; where tax applies it is calculated at checkout.
  • Except where the law gives you a right to a refund, paid interactions are final once aired. If something went wrong, email [email protected] and we will look at it.
  • Chargebacks made without contacting us first may result in loss of access.

Points

  • Points are a feature of the product, not money. They have no cash value, cannot be exchanged for money, cannot be transferred between accounts, and are not property.
  • Points are earned by genuine participation in a creator's chat. Automated or artificial activity earns nothing and may cost you access.
  • Points are scoped to the creator whose chat you earned them in unless stated otherwise in the product.
  • Points are forfeited when an account is closed or terminated, and we may adjust or remove points obtained through a fault, an exploit, or a breach of these terms.
  • A points spend is deducted when the interaction is admitted; if it cannot air, the hold is released.

9. Content and licence

You keep ownership of what you create and send. To operate the service, you grant Yellcano a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, render as speech, and display your content for the purpose of delivering it to the stream you sent it to and letting the relevant creator moderate and review it. That licence ends when the content is deleted, except for copies retained in backups until they age out.

Yellcano, its software, its overlay, its interface and its brand remain ours. Nothing in these terms transfers them to you.

10. Moderation and enforcement

  • Interactions are checked automatically before they can air. Anything that fails is stopped, and the reason is recorded.
  • A creator may block or mute anyone from their page, and may remove anything from their own queue and history.
  • We may remove content, suspend a page, or terminate an account where we believe these terms have been breached, where the law requires it, or where continuing would put someone at risk. Where it is reasonable to do so, we will tell you why.
  • We may act without prior notice when the breach is serious, and we may report unlawful content to the relevant authorities.

11. Third-party platforms

Yellcano connects to services we do not control — Kick, Twitch, YouTube, our payment provider, and the providers behind custom voices. Your use of those services is governed by their own terms and policies, including the YouTube Terms of Service and the Google Privacy Policy. We are not responsible for their availability, their decisions, or changes they make to their APIs — any of which may interrupt a feature of Yellcano without warning.

12. Availability and changes

Yellcano is an evolving product. We add, change, and remove features, and individual capabilities may be enabled or disabled per deployment or per creator. We do not promise uninterrupted availability, and we perform maintenance that may take the service offline.

Where a change materially reduces something you rely on, we will give reasonable notice where we can.

13. Disclaimers

The service is provided “as is” and “as available”. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any particular interaction will air.

Nothing in these terms excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, you keep the statutory rights your local law gives you.

14. Limitation of liability

To the fullest extent permitted by law, Yellcano is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost viewers, or lost data, arising from your use of the service.

Our total aggregate liability arising out of or relating to the service is limited to the greater of the amount you paid us in the three months before the event giving rise to the claim, or €50.

15. Indemnity

You agree to indemnify and hold Yellcano harmless from claims, damages and reasonable costs arising from content you sent or caused to air, from your breach of these terms, or from your infringement of someone else's rights.

16. Termination

You may stop using Yellcano and close your account at any time. We may suspend or terminate access as set out in section 10. On termination, your right to use the service ends immediately; sections that by their nature should survive — content licence for backups, disclaimers, liability, indemnity and governing law — survive.

17. Governing law

These terms are governed by the laws of the jurisdiction in which Yellcano is established, without regard to its conflict-of-law rules, and the courts of that jurisdiction have exclusive jurisdiction over any dispute. If you are a consumer, this does not deprive you of the protection of the mandatory laws of your own country of residence, or of the right to bring proceedings there.
